FASTGUARD — TERMS OF SERVICE

These Terms of Service (the “Terms”) govern your use of the VPN and related services (“Services”) provided by FastDev LLC, registration n umber 271.110.1492495, with its registered address at Davtashen 4th District, Building 11, Yerevan, Armenia (“Operator,” “we,” “us,” or “our”).
By creating an account, purchasing, or using the Services, you agree to these Terms as well as our Privacy Policy and Cookie Policy (together, the “Agreement”). If you do not agree, you must stop using the Services.
1. GENERAL PROVISIONS
1.1 Nature of Services.
We provide access to a Virtual Private Network (VPN) that routes your internet traffic through secure servers. We are not an Internet Service Provider or telecommunications operator; you must independently arrange for internet access.
We do not monitor or control your internet traffic, do not log browsing history or traffic content, and do not determine which laws apply to your online activity. You are solely responsible for using the Services in compliance with applicable laws.
1.2 Service Updates.
We may improve, update, or modify the Services from time to time.If a change materially reduces the functionality of the Services you have paid for, we will notify you in advance and give you an opportunity to cancel before the change takes effect.
1.3 Changes to Terms.
We may update these Terms by posting a new version on our website with a new “Last Updated” date. Material changes will be communicated via email or in-product notice where possible. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
1.4 Equipment and Connectivity.
You are responsible for providing and maintaining your own internet connection, devices, and software necessary for using the Services.
1.5 Third-Party Links.
Our website may contain links to third-party websites or apps. We do not control or endorse third-party resources and are not responsible for their content or availability.
2. Accounts and Security
2.1 Account Registration.
You may need to create an account to use the Services. You agree to provide accurate, complete, and up-to-date information during registration and to keep it updated.
2.2 Security.
You are responsible for safeguarding your login credentials and must notify us immediately if you suspect unauthorized use of your account. Until you do, all actions under your account are considered authorized by you.
3. Subscriptions, Payments, and Renewals
3.1 Plans and Pricing.
Subscription options and prices are listed on our website. We may update prices for future billing cycles with notice provided in advance.
3.2 Payment.
Payments for subscriptions purchased directly on our website are processed by our authorized payment providers.For purchases made through the Apple App Store or Google Play, the respective platform acts as the merchant of record and processes all billing, renewals, and refunds according to its own terms. After subscribing, you will receive a confirmation email summarizing your plan, price, renewal date, and cancellation instructions.
3.3 Automatic Renewal.
Unless you cancel, your subscription will automatically renew at the end of each billing period using your selected payment method. Before each renewal, we will notify you in advance with the renewal date, price, and provide a clear and simple way to cancel if you do not wish to continue.
3.4 Cancellation.
You may cancel at any time via your account dashboard. Your subscription will remain active until the end of the current billing period.
3.5 Money-Back Guarantee & Refunds
FastGuard offers a 30-day money-back guarantee for new subscriptions purchased directly through our website. If you are not satisfied with the Services, you may request a refund within 30 days of your initial purchase.
Renewals, upgrades, and add-ons may be refunded if requested within 7 days of the charge date. Refunds are processed to the original payment method within 10 business days after approval.
By starting to use the Services immediately after purchase, you agree that your refund may be reduced proportionally to cover the time already used before cancellation.
For purchases made through the Apple App Store or Google Play, refunds are handled exclusively by those platforms in accordance with their respective refund policies. FastGuard cannot issue or modify such refunds.
Refund eligibility and timing for App Store or Google Play transactions are determined solely by the relevant platform.
For additional details, please see our Refund Policy at https://fastguard.co/refund-policy. In the event of any inconsistency between this Section and the Refund Policy, these Terms shall prevail.
3.6 Purchases via Apple App Store.
If you purchase your subscription through the Apple App Store using your Apple ID, please note that billing, renewals, and refund requests are handled directly by Apple Inc. under the Apple Media Services Terms and Conditions.
FastGuard does not have access to your Apple billing account, does not collect or store payment information processed by Apple, and cannot issue or modify such refunds.
Refunds for App Store purchases can only be requested through Apple’s official process.
Eligibility and timing of refunds for App Store transactions are determined solely by Apple.
3.7 Failed Payments.
If payment cannot be processed, we may suspend or restrict access until payment is successfully completed.
3.8 Chargebacks
If we receive a chargeback or payment dispute for your subscription, we may suspend access to the Services until the matter is resolved.
4. Acceptable Use
You agree not to misuse the Services. You may not:
  • use the Services for illegal activities or in violation of third-party rights;
  • transmit unlawful, harmful, hateful, defamatory, or infringing content;
  • attempt unauthorized access, hacking, or security breaches;
  • use the Services for spam, malware distribution, or denial-of-service attacks;
  • circumvent network or service limits, or share your account with unauthorized persons.
We may suspend or terminate accounts to protect our network, enforce these Terms, or comply with legal obligations.
5. Privacy
We process only the minimum data required to deliver and secure the Services. We do not log browsing history, traffic contents, or DNS queries. See our Privacy Policy for details on what information we collect and how it is handled.
6. Service Availability and Fair Use
We strive to ensure reliable and continuous operation of the Services but cannot guarantee that they will be uninterrupted or error-free.
We may implement reasonable limits (such as maximum number of simultaneous connections, bandwidth usage caps, or blocking abusive traffic) to maintain service quality for all users. These limits are published in our Fair Use Policy [link], which forms part of these Terms.
7. Disclaimer
The Services are provided “as is” and “as available.” We make no warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. VPN speeds, server locations, and performance may vary.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages — including loss of profits, revenue, business interruption, or data — even if such loss was foreseeable. Our total aggregate liability for all claims in any twelve (12) month period will not exceed the total fees you paid for the Services during that same period.
9. Indemnification
You agree to indemnify and hold us harmless from claims, liabilities, and expenses (including legal fees) resulting from your breach of these Terms or misuse of the Services.
10. Suspension and Termination
We may suspend or terminate your access without notice if you:
  • breach these Terms,
  • fail to pay subscription fees,
  • use the Services unlawfully or in a way that risks security or network integrity.
You may terminate the Agreement at any time via your account; cancellation rules in Section 3 apply.
11. Dispute Resolution
We encourage you to contact us first to resolve any concerns. If a dispute cannot be resolved, you may have the right to use online dispute resolution platforms or other out-of-court resolution mechanisms available under applicable law.
If we cannot resolve a complaint together, you may have access to alternative dispute resolution (ADR) procedures or official online dispute resolution platforms available under applicable law.
12. Governing Law
These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws of your country of residence provide otherwise. You may bring claims in your local courts if required by law.
